.PW Domain Dispute Resolution Policy

The .PW Registry will adopt ICANN’s UDRP for Domain Dispute Resolution and Rights Protection, and TDRP for disputes arising out of inter-registrar transfer cases.

 

1. Domain Dispute Resolution Policy

The .PW Registry values the importance of having a policy that protects Intellectual Property rights of an entity and an individual. To that end, the .PW Registry has adopted the Uniform Dispute Resolution Policy (UDRP) (www.icann.org/udrp) for all .PW Domain Name registrations. Most of the trademark-based disputes can be effectively and efficiently resolved under the UDRP. Trademark owners can choose to file a complaint with either of the following approved domain dispute resolution providers.

The UDRP Policy explains what trademark owners have to prove in order to take a domain name away from the current holder, as well as what domain name holders can use to show that they should be allowed to keep the domain registration. The UDRP Rules outline the actual process for filing a complaint (if you are a trademark owner) and for responding to a complaint (if you are the domain name holder). The registration of any Domain Name(s) shall be subject to suspension, cancellation, or transfer pursuant to any decision under the UDRP.

2. Transfer Dispute Resolution Policy

In any dispute relating to Inter-Registrar domain name transfers, Registrars are encouraged to first of all attempt to resolve the problem among the Registrars involved in the dispute. In cases where this is unsuccessful and where a Registrar elects to file a dispute, the registrar will follow procedures laid down under ICANN’s Transfer Dispute Resolution Policy (TDRP).
